Welcome to Casavely. These Terms of Service ("Terms") apply when you visit casavely.com or buy from us. In these Terms, "Casavely", "we", "us" and "our" refer to Casavely LLC, and "you" refers to you, our customer. By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
1. Eligibility
You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. By ordering, you confirm that you are able to enter into a binding agreement.
2. Our personalized products
Our blankets are woven to order using the photos, names and choices you provide. Before ordering, you can preview your design on the product page, and that preview is what we produce. Product photos, colors and measurements on our site are shown as accurately as we can, but they are approximate. Woven colors look softer than printed photos or screens, fine details are simplified by the weave, and AI-created illustrations may show facial features differently from your original photo in the style you choose. These are characteristics of the product, not defects.
3. Photos and text you send us
When you upload a photo or enter text, you confirm that you own it or have permission to use it, and that it does not infringe anyone else's rights. Please do not submit:
- Characters, logos, brand names or artwork that belong to someone else
- Photos of other people without their permission
- Content that is unlawful, hateful, harassing, sexually explicit or otherwise offensive
We may refuse or cancel any order that we believe includes such content, with a full refund. We use your photos and text to create, deliver and support your order. We will not use your personal photos in our marketing without your permission. Please see our Privacy Policy for how we handle your information.
4. Orders, pricing and payment
All prices are in US Dollars (USD) and may change without notice. A binding contract is formed only when we send your order confirmation email. We may refuse or cancel an order at any time, for example if a product was listed at the wrong price because of an error, if we cannot verify payment, or if the content breaks Section 3. If we cancel, we will refund the full amount you paid. Multi-item savings and discount codes apply as shown at checkout. More details are in our Billing Terms and Payment Methods pages.
5. Shipping, returns and cancellations
Our Shipping Policy and Returns & Refunds policy are part of these Terms. In short, because every item is personalized, we do not accept change-of-mind returns, but we will remake or refund items that arrive defective, damaged, or different from the preview you approved, when reported within 7 days of delivery.
6. Intellectual property
The content of this website, including text, graphics, design templates, product photos and the Casavely name and logo, belongs to us or our licensors. You may not copy, reproduce or reuse it without our written permission. You keep the rights you already have in the photos you send us.
7. Reviews and feedback
If you post a review, comment or other feedback on our site, you give us permission to display, reproduce and share it, including on our website and social media, and to edit it for length or clarity without changing its meaning. If you share a photo of your blanket with us, we will only use it publicly with your permission. We may remove any review or comment at our discretion.
8. Prohibited uses
You agree not to use our website to break any law, infringe anyone's rights, harass others, send spam, upload malicious code, interfere with the site's security, or collect data from the site using automated tools. We may suspend or block access for anyone who does.
9. Disclaimer of warranties
Our website and products are provided "as is" and "as available". Apart from the commitments in our Returns & Refunds policy and any rights you have under applicable law, we make no other warranties, express or implied.
10. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of our website or products. Our total liability for any claim related to an order will not exceed the amount you paid for the product in question. Nothing in these Terms limits any rights you have that cannot be limited by law.
11. Indemnification
You agree to cover us against claims, losses and costs (including reasonable legal fees) that arise from your breach of these Terms, your violation of any law, or content you submit that infringes someone else's rights.
12. Governing law
These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in Missouri.
13. Severability
If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in effect.
14. Changes to these Terms
We may update these Terms from time to time by posting a new version on this page. The version in effect when you place your order applies to that order. Continuing to use the site after changes are posted means you accept them.
